Legislative sick leave is paid time off due to illness based on the Employment Standards Act (ESA).
Legislative sick leave provides all employees 5 days of paid sick leave per calendar year. New employees will gain access to this sick leave after 90 days of employment.
How UBC manages legislative sick leave
Given that paid sick leave entitlements for most UBC employees already meet the ESA requirements, they will not receive any additional paid sick time within Workday. Only employees who are not entitled to at least 5 days of paid sick leave under their employment group's collective agreement, handbook, etc., will receive legislative sick leave. These employment groups include the following:
- BCGEU Vancouver (Child Care) – Auxiliary only
- BCGEU (UBCO) – Auxiliary only*
- CUPE 116 – Auxiliary only*
- CUPE 116 (Aquatic Centre) – Student
- Miscellaneous employees
- Student employees (excluding GRA and URA fellowship)
Employees not in the groups listed above should see paid sick leave for details of their time off plans. In some cases, employees with paid sick leave need an adjustment to meet legislative leave requirements. The additional information below is only for groups who are eligible for and receive legislative sick leave.
*New employees in these employment groups will have access to both legislative sick leave and paid sick leave in their first year of employment.
